Competition Terms and Conditions

Parties

These terms and conditions (Terms) are entered into between Riparide Pty Ltd ABN 16 154 577 456 (we, us or our) and you, together the Parties and each a Party.

The Terms become effective and binding upon the Parties at the time it is accepted by you, which shall include by electronic means.

Promoter

The promoter of the Competition is Lacey Spalding (Promoter)

Competition Name & Duration

We are running a competition called the “Riparide & Lacey Spalding Giveaway” subject to these Terms (Competition)

The Competition runs from 12:01am PT on May 3rd, 2022 until 11:59pm PT on May 18th, 2022.

Prize

The winner of the Competition will be awarded a gift voucher for use on the Platform for the amount of US$1,000 (Prize)

For clarity, the Prize does not include (without limitation):

The value of the Prize is a maximum of US$1,000.

The Prize is valued in American dollars.

The Prize must be taken as offered and is not exchangeable, transferable, redeemable for cash or for resale. In the event that a Prize is unavailable, the Promoter reserves the right to substitute a Prize of equal or greater value.

Photographic identification of the winner will be required (such as driver’s license, passport or student card where photo is included) to claim a Prize.

In exceptional situations, and subject to our absolute discretion, a winner may nominate a designated representative to collect a Prize. The representative will be required to present written authorization from the winner and photographic identification of both the winner and their representative to collect the Prize.

Drawer & Winner

The winner(s) will be randomly selected by a computerized random generator from the database of all entries.

The selection of winner(s) will be final and not subject to review.

The winners will be notified by direct message through the Instagram account that they submitted their entry on.

If the winner does not confirm acceptance of the Prize in writing within 48 hours of receiving notice from us, then we may, in our complete discretion:

We shall not be responsible for any winners not receiving a message as a result of incorrect contact details being provided to us.

Entry & Conditions

Everyone who lives in Washington state, and likes and tags three friends on Lacey’s competition post on Instagram, as well as follows @riparide.USA and @LaceySpalding, is eligible to enter the competition.

Acceptance of the Prize is conditional upon showing evidence you are over 18 years of age.

Employees of the Promoter and their families may not enter the Competition.

You may only enter the Competition once unless we agree otherwise. Only the first received entry will be valid if more than one entry is received from any single participant.

Conditions of Entry

By entering the Competition, you agree to be bound by these Terms and any terms and conditions advertised on our website or otherwise notified by us specific to the Competition.

It is the sole responsibility of each entrant to ensure that their entry meets the conditions of entry to be eligible to win a Prize. This includes submitting the entry within the entry dates and ensuring the entry is complete and comprehensible. For clarity, entries not completed in accordance with the conditions of entry or received after the closing date will not be considered by us, and we take no responsibility for such in any way.

Privacy

The details contained in your entry are protected by security safeguards as detailed in the Promoter's Privacy Policy, which is also available on their website. The personal information collected as part of the entry is collected to enable identification of the winner and for future marketing and promotional purposes. Your personal information will only be disclosed to the Promoter and its related bodies corporate for these purposes and/or in accordance with our Privacy Policy. You can contact our Privacy Officer if you would like details of the personal information that the Promoter may hold about you or if you would like it to be corrected or deleted. If for any reason the Competition does not run for its duration due to a computer virus, tampering, unauthorized intervention, fraud, technical failures or any other cause beyond the control of the Promoter that corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the Competition or disqualify any individual who tampers with the entry process. The Promoter is not responsible for any:

Malfunction, delay or traffic congestion on any telephone network or line, computer on-line system, servers or providers, computer equipment, software, or website;

Failure of any email or entry to be received by the Promoter; nor

Any injury or damage to entrants or any other person related to or resulting from participation in the competition or downloading any materials in a competition.

Limitation of Liability

The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any goods or services offered as Prizes. To the extent permitted by law, the Promoter is not liable for any loss suffered to person or property by reason of any act or omission, deliberate or negligent, by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods and services by any person to the prize winner and, where applicable, to any persons accompanying the prize winner.

This clause does not affect any rights a consumer may have which are unable to be excluded under Australian law. To the fullest extent permitted by law, any liability of the Promoter or its employees or agents for breach of any such rights is limited to the payment of the costs of having the prize supplied again.

Governing Law

This relationship of the parties under these Terms shall be governed by the laws of Victoria, Australia. Each of the parties hereby submits to the non-exclusive jurisdiction of courts with jurisdiction there.
